Lucknow Webs Terms of Service (TOS)
You must agree to the below terms of service before you can create your Lucknow Webs account. You will not be permitted to make any purchases unless you agree to the below terms of service.
Our terms of service (TOS) are designed to provided to our customers a clear and transparent understanding of what we expect of them while they are using our service(s). The use of Lucknow Webs service(s) represents your acceptance and agreement to Lucknow Webs (TOS), regardless of whether you have read them or not.
1) Account Setup
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s). All new orders are usually activated within 24 hours.
2) Content & Activities
All services provided by Lucknow Webs may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene. The customer agrees to indemnify and hold harmless lucknowwebs.com from any claims resulting from the use of our services.
Examples of Totally Unacceptable material:
IRC Bots.
Warez Sites.
MP3's (unless You are the Artist).
Password sharing sites.
Sites that run any type of proxy script.
Pirated Software/Scripts.
Hacked programs and archives.
2.1) Distribution of Malicious Code:
Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data and/or computer systems are prohibited. Examples of this are computer viruses, Trojan-horse programs and Internet-based worms. Such an offense will result in the immediate termination of the offending account.
2.2) Infringement
Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. It is not permitted to use Lucknow Webs to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources and the unauthorized transmittal of copyrighted software.
2.3) File Hosting
File hosting and file storage of any type is strictly prohibited on any and all servers within the Lucknow Webs network. You MAY NOT use your Lucknow Webs account as a download or file storage repository. Our services are strictly offered for website hosting only. This does NOT mean that you can not have downloads on your site. This means you can not operate a site that specializes in downloads like Download.com or similar and you may not use your Lucknow Webs account as storage repository for MP3, games, video, audio or music files. Your account may not exceed 10% of used space in MP3, games, video, audio or music files.
2.4) Designing and uploading
Designing, uploading and editing etc of the site will be done at our premises only. In case the client wants us to do that at their campus or office that will be done at a time that suits us and will attract an excess hourly payment of Rs 2500/- per hour.
2.5) Adult Sites
Due to various legal and moral implications. Lucknow Webs does not permit sexually explicit material on any of its servers. If your site even resembles and/or implies any of this nature, your account will be terminated without notice.
2.6) Promotional Offers(If any)
The terms and condition for promotional offers differ from time to time and is offer specific. It is written in the promotional offer page itself. However, some basic points should be noted-
(1) Ample webspace will be provided for the website to a max limit of 10mb.
(2) There will be maximum of 10-12 pages in the website.
2.7) Time Period
Once a project is started, we are to be provided adequate data as per the requirement of the site. Once the site process has been initiated, please note, we will wait for data maximum upto 2 months (60 days) from the day the project was commenced. Failing to provide data delays our work unnecessarily hindering the completion of the project. In case of delay of data for more than 60 days we will consider the project as "dropped" by the client and we will stop further development of the site. If the client wishes to revive the project after 60 days, that will attract an excess fee of Rs6,000/- irrespective of the nature of the project.
Incase the party decides to terminate the site development by Lucknowwebs after 60 days of initiation of the project development , there will be no refund of the advance money that may have been paid by the client (partial or full). The server space and domain names registered will become property of Lucknowwebs unless the full fees is paid in cash including the renew charge of Rs.6000/-
2.8) Refunds
Once an order is placed for any of the service/services whether direct or out sourced or of any nature and the payment is made. Please note there is no refund (partial or full) if in case you are not satisfied with the services provided. You are urged to clarify all your doubts by discussion over the telephone, through email or via chat before finalising the deal and making the payments.
